This position reports to Legal/Integrity Manager Your role and responsibilities This role will report to the ABB Motion Regional General Counsel for the Americas in Milwaukee, Wisconsin, USA with a dotted-line to the Business lead for Motion – Brazil.
Act as Business Partner to the Motion Business in Brazil, whilst maintaining an independent position.
Develop close working relationships with ABB internal customers including commercial business teams, sales, finance, HR, EHS, and supply chain functions.
Develop contract strategy based on customer requirements, ABB policies, and the overall execution strategy considering risk, pricing, scope, and schedule.
Draft and negotiate commercial contracts with customers and suppliers for the Motion Brazil Business, as well as frame agreements on a global level or between multiple Business Areas.
Collaborate with other Legal Counsels in the development of contract standards, templates, and guidelines and ensure their implementation and operationalization within Brazil and across Latin America.
Provide training and guidance to the Motion Brazil Business.
Develop and implement risk mitigation and opportunity plans together with the local Project Managers and/or Sales Managers.
Ensure that relevant (sub) contracts contain appropriate contract terms and conditions to protect ABB’s interest, including flow-down of main contract terms.
Provide general guidance and management of legal issues in respect of competition laws, privacy and data protection including GDPR, product liability and warranty claims, and other legal matters that arise within the business in collaboration with other members of the global ABB legal team and internal and external subject matter experts.
Support in managing contractual claims and advise on the resolution of disputes or commercial/civil litigation through external advisors when necessary.
Support our business with other general legal advice and questions related to integrity; may assist in investigation and resolution of any integrity issues that arise in the MO Brazil business.
Be an active member of the Motion Americas and global Legal & Integrity team and assist with other legal matters and projects as assigned.
Qualifications for the role Law degree (Brazil) and passed OAB Bar Examination.
Member of the Brazil bar in good standing with no disciplinary history.
Solid experience practicing commercial law, either as a private practice associate or as an in-house legal counsel.
Fluency in Portuguese and English with strong communication, presentation and networking skills, and ability to review legal documents in both languages is a must.
Spanish language proficiency at a level sufficient to review contracts and other legal documents in Spanish is desirable.
Strong drafting and negotiation skills, along with experience advising on both product and service-related legal issues, are essential for working effectively in a complex international environment.
Experience with projects related contracts, distribution/partner agreements, government contracting, and intellectual property is desired.
Experience with digital law (SAAS, cyber law, AI, data protection and data privacy, etc.) is highly desirable.
Having experience in a similar industry would be an advantage.
Additional bar memberships or cross-training and experience with other LATAM country law and/or United States or European Union laws would be an advantage.
Must be well-organized and able to manage multiple assignments simultaneously under deadline pressure.
Candidates should have a proactive, hands-on approach, experience in multicultural settings, and the ability to adapt and solve problems flexibly within a dynamic, minimally standardized compliance framework.
